Refund and Cancellation Policy
This Cancellation and Refund Policy (hereinafter “Policy”) applies to all online yoga courses purchased through www.yoga.in, which is owned and operated by Homevilla Yoga Private Limited (hereinafter “the Platform,” “We,” “Us,” or “Our”).
As www.yoga.in hosts and facilitates access to online yoga courses developed and offered by various independent third-party institutions and instructors (hereinafter “Course Providers”), this Policy outlines the terms for refunds and cancellations, acknowledging the distinct responsibilities between the Platform and the Course Providers.
By completing a purchase and registering for any course on www.yoga.in, you, the user (hereinafter “You” or “Your”), explicitly acknowledge, understand, and agree to be bound by the terms and conditions stipulated herein.
1. Our Role as a Platform
www.yoga.in serves as an online platform that connects You with Course Providers offering various yoga courses and experiences. While We facilitate payment processing and provide You with access to the Course Providers’ content, the intellectual property, content, curriculum, and direct instruction for each course are solely the responsibility of the respective third-party Course Provider. Our liability concerning the course content itself is limited as set forth in Section 5 of this Policy.
2. Refund Policy for Course Purchases (Governed by Course Providers)
(a) General Principle: For courses purchased on www.yoga.in that are provided by a third-party Course Provider, the refund policy for the course content is primarily governed by the specific terms and conditions set forth by the individual Course Provider. We strongly advise You to review the Course Provider’s refund policy, typically available on the course description page or through a link provided therein, before making a purchase.
(b) Facilitation of Refunds by Homevilla Yoga Private Limited: While the Course Provider determines the eligibility for a refund, Homevilla Yoga Private Limited will facilitate the processing of approved refunds to Your original payment method, provided the Course Provider has authorized the refund to Homevilla Yoga Private Limited. Our ability to process a refund is contingent upon the Course Provider’s approval and their adherence to their stated refund terms.
(c) Common Reasons for Denied Refunds (Illustrative, subject to Course Provider policy):
Refunds are generally not provided under circumstances including, but not limited to:
- Non-Attendance/Non-Participation: If You are unable to attend, access, or complete the course for reasons such as personal scheduling conflicts, technical issues on Your end, lack of engagement, or any other personal decision not to utilize the purchased course.
- Significant Course Consumption: If a substantial portion of the course content has been accessed or completed by You.
- Refund Request Outside Stated Window: If the refund request is submitted beyond the timeframe specified in the Course Provider’s refund policy.
- Violation of Terms of the Platform or the Course Provider: If Your access to the course was terminated due to a violation of the Course Provider’s or the Platform’s terms of service.
3. Course Cancellation by Homevilla Yoga Private Limited (Platform-Related)
In the rare event that Homevilla Yoga Private Limited is compelled to cancel a course offering on its platform prior to commencement of the course, You shall be entitled to the option to receive a credit equivalent to the full amount paid, which can be redeemed towards enrolment in any other online yoga course available on www.yoga.in. This credit must be utilized within a period of six (6) months from the date the original course cancellation was officially announced by Homevilla Yoga Private Limited.
4. Additional Charges for Course Exchange (Platform Credit)
If You choose to enrol in another course using Platform Credit as per Clause 3:
- If the selected new course has a higher price than the original cancelled course, You shall be solely responsible for paying the additional charges equivalent to the price difference.
- If the selected new course has a lower price than the original cancelled course, partial refund or credit for the difference will be issued to You.
5. Limitation of Liability for Third-Party Content
You understand and agree that:
- Homevilla Yoga Private Limited makes no warranties or representations regarding the quality, accuracy, completeness, or suitability of the content provided by Course Providers. Any issues related to the pedagogical quality, accuracy of information, or instructor performance must be addressed directly with the respective Course Provider.
- Homevilla Yoga Private Limited shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if Homevilla Yoga Private Limited has been advised of the possibility of such damages), resulting from Your use of, or inability to use, courses provided by third-party Course Providers.
Our liability for any issues arising directly from the Platform’s service (e.g., payment processing errors by Homevilla Yoga Private Limited, or platform-wide technical outages) shall be limited to the amount paid by You for the affected course.
6. General Provisions and Modifications
(a) Right to Modify: Homevilla Yoga Private Limited reserves the unequivocal right, at its sole discretion, to modify, amend, or update this Cancellation and Refund Policy at any time, without prior individual notice. Any such changes will become effective immediately upon their posting on yoga.in.
(b) Acceptance of Terms: By proceeding with the registration and purchase of any course on yoga.in, You explicitly acknowledge and confirm Your understanding and agreement to all the terms and conditions set forth in this Cancellation and Refund Policy. It is Your responsibility to review this Policy periodically for any updates or changes.
(c) Governing Law and Jurisdiction: This Policy shall be governed by and construed in accordance with the laws of India, specifically within the jurisdiction of Mumbai, Maharashtra. Any disputes arising under or in connection with this Policy shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
